This site is maintained as a service to our customers. By using this site, you agree to comply with and be bound by the following terms and conditions of use. Intended Audience. This Site is intended for use by adults.  Nonetheless to the extent any children use this cite our Privacy Policy is guided by the United States’ Children’s Online Privacy Protection Act of 1998, as well as data privacy laws in the United States, and can be viewed at http://wwwecocaf.com.

 

5. Trademarks. “Eco Caf”, “Eco Product Systems” and others are either trademarks or registered trademarks of EPS. Other product and company names mentioned on this Site may be trademarks of their respective owners.

 

6. Site Use. EPS grants you a limited, revocable, nonexclusive license to use this Site solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy materials on the Site, reverse engineer or break into the Site, or use materials, products or services in violation of any law. The use of this Site is at the discretion of EPS may terminate your use of this Site at any time.

 

7. Compliance with Laws. You agree to comply with all applicable laws regarding your use of the Site. You further agreed that information provided by you is truthful and accurate to the best of your knowledge.

Indemnification. You agree to indemnify, defend and hold EPS and our partners, employees, owners, agents, directors, officers, representatives and affiliates, harmless from any liability, loss, lawsuit, damage, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Site.

 

9. Disclaimer.

 

THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS. EPS MAKES NO WARRANTIES OR REPRESENTATIONS AS TO THE ACCURACY OF THE INFORMATION AND CONTENT ON THIS SITE. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. EPS DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.

Force Majeure. EPS shall be not held liable for any delay or failure in performance of any part of this Agreement from any cause beyond our control and without our fault or negligence, such as acts of God, acts of civil or military authority, current laws and regulations and changes thereto, embargoes, epidemics, war, terrorist acts, riots, insurrections, fires, explosions, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, other major environmental disturbances, unusually severe weather conditions, acts of hackers and other illegal activities of third parties, inability to secure products or services of other persons or transportation facilities, acts or omissions of transportation or telecommunications common carriers, or acts, omissions, overloading, or slow downs over the internet or any third party internet service providers.

 

14. Copyrights and Copyright Agent. If you believe your work has been copied in a way that constitutes copyright infringement, please provide a notice containing all of the following information to our Copyright Agent:

 

(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

(b) A description of the copyrighted work that you claim has been infringed;

(c) A description of where the material that you claim is infringing is located on the Site;

(d) Your address, telephone number, and e-mail address;

(e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

15. Applicable Law. You agree that the laws of the state of California, without regard to conflicts of laws provisions will govern these Terms and Condition of Use and any dispute that may arise between you and ECO Product Systems, LLC or its affiliates.

 

16. Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

                                                 

17. Termination. EPS may terminate this Agreement at any time, with or without notice, for any reason.

 

18. Survivability. The ownership and proprietary rights provisions set forth in this Agreement, and any other provisions that by their sense and context the parties intend to have survive, shall survive the termination of this Agreement and any obligations hereunder for any reason.

 

19. Interpretation. The fact of authorship by or at the behest of a party shall not affect the construction or interpretation of this Agreement.

 

20. Entire Agreement. This Agreement embodies the entire agreement and understanding of the parties and supersedes all prior agreements, representations, and understandings between the parties relating to the subject matter of this Agreement.
